1. Acceptance of Terms

By accessing or using just build things ("we", "us", "our", "the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our Service.

2. Description of Service

just build things is a web platform that provides AI-powered tools and creative utilities including:

  • AI image generation and analysis
  • AI writing and chat tools
  • Audio and PDF analysis tools
  • Design and development utilities
  • Music and creative tools
  • Games and productivity tools

3. User Accounts

Account Creation: Some features require account creation. You must provide accurate information and maintain the security of your account credentials.

Account Responsibility: You are responsible for all activities under your account. Notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Generate, upload, or share content that is harmful, offensive, or violates others' rights
  • Attempt to gain unauthorized access to our systems
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or engage in spam
  • Reverse engineer or attempt to extract source code
  • Use the Service for commercial purposes without proper licensing

AI Content Generation Restrictions: When using our AI tools to generate content, you specifically agree NOT to:

  • Generate illegal content: Create content that violates any applicable laws or regulations
  • Generate content that violates others' rights: Create content that infringes on intellectual property, privacy, or other rights
  • Generate harmful/offensive content: Create content that is discriminatory, hateful, violent, or otherwise harmful

Note: While we implement measures to prevent misuse, you are ultimately responsible for ensuring your use of AI-generated content complies with all applicable laws and these Terms.

5. Content and Intellectual Property

Your Content: You retain ownership of content you upload or create. However, you grant us a license to process your content to provide our services. We do not claim ownership of your content.

Generated Content: Content generated by our AI tools is provided as-is. While you can use generated content, you are responsible for ensuring its appropriateness and legality for your intended use. All content generation is subject to the restrictions outlined in Section 4 (Acceptable Use).

Our Content: The Service and its original content, features, and functionality are owned by us and are protected by intellectual property laws.

6. Subscriptions and Payments

Free and Paid Services: We offer both free and paid services. Free services may have usage limitations. Paid subscriptions provide additional features and higher usage limits.

Billing and Payment Processing: Subscription fees are charged in advance on a monthly basis. Payment is processed securely through Clerk, our third-party payment processor. You are responsible for providing valid payment information and maintaining current payment details.

Payment Failures: If your payment fails, we may suspend or cancel your account until payment is resolved. We are not responsible for any fees your bank or payment provider may charge for failed payments.

Pricing and Currency: All prices are listed in USD. We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

Taxes: You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction. Our listed prices do not include such taxes unless explicitly stated.

Refunds and Cancellation: You may cancel your subscription at any time via your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial months or unused portions of your subscription, except where required by applicable law. All sales are final once access to the Service is granted.

Disputes and Chargebacks: Before initiating any payment dispute or chargeback, you must contact us at support@justbuildthings.com and allow us 7 business days to attempt a resolution. If you file a chargeback without contacting us first, you may be liable for processing fees, administrative costs, and your account may be suspended or terminated immediately.

By filing a chargeback, you agree that we may present evidence including transaction details, account activity records, timestamps, and proof of service usage to the payment processor or financial institution. You waive any right to assert an "unauthorized transaction" defense if your account credentials or payment information were used by someone else, unless you notify us immediately upon discovering the unauthorized access.

Service Delivery: For digital services, delivery is considered complete when you gain access to the Service or when the requested output is generated. By using the Service, you acknowledge receipt of digital goods and services.

Evidence and Documentation: You agree that we may collect, store, and present records of your activity (including timestamps, tool usage, and feature access) as proof of service delivery. Your acceptance of these Terms (via checkbox, continued use, or other method) constitutes binding consent.

Third-Party Payment Processors: We use Clerk as our payment processor. Your payment information is subject to their terms of service and privacy policies. We do not store your payment information on our servers.

7. Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  • AI-generated content may not always be accurate or appropriate
  • We are not responsible for content generated by AI tools, though we have usage restrictions
  • Service interruptions may occur due to technical issues
  • Third-party AI services may have their own limitations and content policies

9. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE LAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction in the United States.

Consumer Rights: For users in the European Union, United Kingdom, or other jurisdictions with mandatory consumer protection laws, your local consumer rights take precedence over any conflicting provisions in these Terms. Nothing in these Terms affects your statutory rights as a consumer that cannot be waived by contract.

Dispute Resolution: Before pursuing formal legal action, we encourage you to contact us to seek an informal resolution. Most disputes can be resolved quickly and amicably through direct communication.
